CALL TO ORDER

Pursuant to date and place stated above, Chairman Reynolds called the meeting to order at 2:27 p.m.

APPROVAL OF MINUTES
Upon a motion by Mr. Bowen, second by Mr. Jones, the Board approved the minutes of the State Board meeting of Thursday, August 12, 2004.

Mr. Steve Dougherty, President of North Metro Technical College was present and recognized a local Board member and Chairman, Keith Sandlin.


COMMITTEE REPORTS

ADULT LITERACY COMMITTEE

Mr. Rakestraw gave an update of the Adult Literacy activities and there were no motions.


BUDGET, FACILITIES AND TECHNOLOGY COMMITTEE

I. Approval of Architectural Contract
A. Upon a motion by Mr. Copeland, second by Mr. Daniel and Ms. Lyons, the Board approved to authorize the Commissioner to enter into a Architectural contract with Ellis, Ricket and Associates, Inc., Valdosta, Georgia, for Project No. DTAE-104, Classroom Building,Valdosta Technical College, in the amount of $854,000.00, provided, payment to Ellis, Ricket and Associates, Inc. , shall not exceed $200,900.00 until such time as G.O. Bonds are sold to fund construction of the project; and, provided further, the Commissioner shall be authorized to execute an Assignment of Architectural Contract assigning and transferring to the Georgia State Financing and Investment Commission the Architectural contract with Ellis, Ricket and Associates, Inc., for Project No. DTAE-104, Classroom Building, Valdosta Technical College at such time as funding for construction of Project No. DTAE-104 is available.

II. Approval of Policy Revisions

A. Upon a motion by Mr. Copeland, second by Ms. Lyons, the Board approved to accept the changes to State Board Policy Revision for Student Tuition and Fees for all Technical Schools.

V. K. Student Tuition and Fees

Students attending Technical Colleges shall normally be charged tuition and related fees unless otherwise exempted by State Board Policy. Tuition for courses in curriculums leading to a diploma or associate degree shall be charged on a uniform basis among all Technical Colleges.

The State Board shall annually review and establish application, tuition, and other fees charged by all Technical Colleges. Local boards may recommend to the State Board student activity fees and miscellaneous services fees annually. Local boards may approve non-revenue producing student-insurance fees without approval of the State Board.

Because of the availability of various state and federal aid programs the Board believes that no Georgia resident should be denied access to Technical College programs because of a financial inability to pay tuition and fees. Payment of tuition and fees may be deferred if Technical Colleges have confirmation of the student's eligibility for financial aid whether from a government entity, business/industries, work-study, foundations, or other sources of financial assistance.

Student fees shall be considered as a source of revenue when developing annual budgets. Any revenues exceeding budgeted estimates shall be amended into the annual operating budget during the course of the fiscal year.

Non-Resident Students
Students who are classified as non-resident students under the Board's State Residency Policy shall normally be charged a rate of tuition twice that charged for students who are classified as resident students. The Commissioner may approve exceptions to this policy, provided:

i) A written application is submitted by the institution.

ii) There is evidence of a written reciprocity agreement with appropriate institutions in another state.

Under no circumstances shall non-resident students be charged tuition or fees lower than that charged resident students.

Inasmuch as the Technical Colleges exist primarily to serve the residents of Georgia, non-resident students shall be enrolled on a space-available basis.

International Students
International students who are not residents of the United States and are in the United States pursuant to a student visa shall pay a tuition amounting to four (4) times that paid by a resident of Georgia. A presidential exception may be granted which waives the 4-times tuition rate. These students may pay in-state rates, but are not eligible for HOPE.

All fees, other than tuition (i.e., application, activity, insurance and library) shall be the same as for a state resident.

International students who are residents of the State shall pay the same tuition as Georgia students.

International students shall be enrolled on a space available basis and shall not displace any student desiring to enroll who is a resident of the State.

Waiver of Student Tuition and Fees
The Commissioner may develop procedures authorizing the waiver of student tuition and fees upon good cause. The Commissioner may develop procedures authorizing the Presidents, as an exercise of discretion, to waive student fees under certain circumstances.

Georgia residents over sixty-two (62) years of age who are otherwise qualified may attend Technical Colleges and adult centers without payment of tuition on a space available basis.

Adult literacy students attending the adult basic education programs shall not be charged tuition, or any other fee, nor be required to purchase any books or other materials that are needed for participation in the program.

Refunds of Tuition and Fees
All tuition and fees, excluding the application fee, shall be refunded if a student formally withdraws prior to the first day of class of any quarter.

For those students not receiving federal financial aid, seventy-five percent of their tuition shall be refunded if they formally withdraw within 7 consecutive calendar days of the first day of the quarter. Students withdrawing after seven days shall receive no refund. For those students receiving federal financial aid, the Technical Colleges shall refund unearned tuition, fees and other charges in accordance with the Department's federally mandated fair and equitable refund policy for all students who receive Title IV assistance. The Technical Colleges shall publish all student fee charges and refund policies in appropriate catalogs and elsewhere as appropriate.

Refunds of books and supplies
No refunds shall be made for returned used supplies and equipment such as cosmetology kits, diskettes, tools, and uniforms.

Refunds shall be made for books that are returned in new condition and accompanied by a receipt. The book refund policy shall be prominently posted in the Technical College bookstore.

Technical Colleges that have contracted out their bookstore operations shall ensure that the contractor adheres to this policy.

B. Upon a motion by Mr. Copeland, second by Mr. Daniel, the Board approved to accept the changes to State Board Policy Revision for Tuition Remission and Reimbursement for approved Staff Development for all Technical Colleges.

III. U. 10. Tuition Remission and Reimbursement for Approved Staff Development
Credit Classes

The Department and its Technical Colleges encourage full-time faculty, staff, and administrators to participate in staff development activities and study by remitting tuition and fees for those Technical College educational activities that have been authorized by the employee's President or Assistant Commissioner and are clearly related to the employee's job or career in the organization. Tuition and fees will be remitted to the extent an employee is not eligible for financial aid.

Upon completion of the course, the employee must present a transcript to his or her supervisor indicating that the course was "successfully completed." A course is "successfully completed" when the criteria set by the supervisor has been achieved or when a grade of C or better is earned depending on course requirements to receive credit. A course must be successfully completed in order for the tuition to be paid by the employer and for the course to count as a staff development activity. If a course is not successfully completed, then the employee shall reimburse his or her employer for all costs paid by the employer.

1) Full-time Employees (who meet the applicable admission standards and have received appropriate prior authorization from the President of the institution) may register without tuition or fees on a space available basis at his or her Technical College for approved staff development.

2) Full-time Employees (who meet applicable admission standards and have received appropriate prior authorization from their President or Assistant Commissioner) may register for courses at a Technical College where he or she is not employed for approved staff development. Unless the sending employer has made other arrangements, the sending employer will reimburse the receiving institution for tuition and fees.

3) Full-time Employees of a Technical College may attend credit classes offered by their college as part of their staff development plan without registering as "auditors" and without credit being offered for such attendance. Employees should obtain permission from their immediate supervisor to attend such classes. Supervisors should establish the necessary criteria to demonstrate successful completion.

Non-credit Courses
At the discretion of the President, employees may attend non-credit courses on a space-available basis at the Technical College where they are employed at a reduced rate or without payment of a fee.

Action Items

A. Upon a motion by Mr. Copeland, second by Ms. Lyons, the Board approved to accept the proposed Board Policy concerning Technical College Names to lie on the table until the next regularly scheduled Board meeting.

I. C. 3. Technical College Names and Other Departmental Facilities

The State Board reserves the right to name or grant final approval of the name of each Technical College, off-campus facility and campus building within the jurisdiction of the State Board. Requests to name or to change the name of a college, facility or building must be submitted to the Commissioner by the Local Board of Directors. The Commissioner shall review all requests and submit such requests, with recommendations, to the State Board for consideration.

Generally Technical Colleges and off-campus facilities shall bear the name of a political subdivision, a region, or a geographical feature of Georgia. Technical Colleges and off-campus facilities shall not be named after an individual or individuals whether living or dead. An off-campus facility shall include the name of the host Technical College in its official name.

Official signage identifying Technical Colleges and off-campus facilities must include "A Unit of the Georgia Department of Technical and Adult Education."
An individual room within a building on a Technical Colleges campus or off-campus facility may be named in honor of an individual who is deceased by the Local Board of Directors of the Technical College as long as such name is in accordance with state law.

The Board may grant exceptions to this policy for good and sufficient reasons and upon application by the local Board of Directors of the Technical College.

B. Upon a motion by Mr. Copeland, second by Ms. Lyons, the Board approved to accept the proposed Board Policy concerning State Board Responsibilities and Authority to lie on the table until the next regularly scheduled Board meeting.

I. C. 1. State Board Responsibilities and Authority

The Board shall provide overall policies for the management of public postsecondary technical and adult education to ensure that the needs of the citizenry, business, and industry are met to the highest possible degree and in the most cost-effective and efficient manner.

The Board shall establish its guiding policies, subject to change from time to time, but all of which shall be in accordance with the established objectives and the trusteeship to the public.

The policies of the Board may be amended and/or adopted by the Board acting collectively at any meeting of the Board subject to the Board's bylaws.

Responsibility
The Board shall:

1) Provide overall policy guidance to the Commissioner, who is responsible for day-to-day operations on behalf of the Board.

2) Approve overall goals and objectives for public postsecondary technical and adult education.

3) Approve annual and long-range plans for public postsecondary technical and adult education.

4) Approve changes in organizational structure or functional assignments for the Commissioner and organizational level reporting immediately to the Commissioner.

5) Employ, dismiss, and establish the salary of the Commissioner.

6) Delegate to the Commissioner the authority to hire and fire Department employees and to establish salaries in conformance with State laws and regulations.

7) Approve all new technical education programs for public postsecondary technical education and the deletion or modification of existing programs.

8) Review recommendations for annual and supplemental budget requests for all public postsecondary technical and adult education and make recommendations to the Governor and the General Assembly.

9) Establish policies and review and approve those proposed and established by the Commissioner so that the Department's operations shall meet the Board's goals and objectives.

10) Consider and act upon the following:

a) All legislation proposed by the Department.

b) All actions required by law to be taken by the Board.

c) Proposals for state-level advisory committees and the committees' membership. Members serve at the pleasure of the State Board and may be removed by the Board at any time based upon the Commissioner's recommendation.

d) All proposals for membership on local boards of directors of state technical institutes and colleges. Members serve at the pleasure of the State Board and may be removed by the Board at any time based upon the Commissioner's recommendation.

e) Non-personnel contracts of Technical Colleges or the Department that exceed $25,000 in total annual cost, including those at locally owned colleges funded with state monies. All contracts for construction, leases, equipment and furniture which exceed $75,000 in total annual cost. The Board shall also act upon all change orders or amendments to construction contracts that exceed twenty percent of the original contract cost. “Construction contracts” include contracts for repair or renovation.


This paragraph applies to projects at locally owned colleges when funded with state monies.

f) Change orders or amendments in existing non-personnel and non-capital outlay contracts, exceeding a one-time cost of $5,000, including those at locally owned colleges funded with state monies. All non-personnel contracts, including amendments, change orders and renewals thereto, which exceed $25,000 in total annual cost. The Board shall also act upon all change orders or amendments to existing non-personnel contracts that exceed a one-time cost of $5,000.

This paragraph applies to projects at locally owned colleges when funded with state monies.

g) Change orders or amendments in capital outlay contracts of Technical Colleges that exceed twenty percent of the contract cost, including those at locally owned colleges funded with state monies.

h) g)all plans to promote the Board's activities and solicit funds.

11) Represent the State with other postsecondary technical and adult education agencies in Georgia, in other states, and at the national level.

12) Make recommendations for improving public postsecondary technical and adult education.

A. Atlanta Technical College, Fresonius Medical Care four (4) 2008k System-hemodialysis equipment, Armstrong Industries heart training system with crisis manikin, LJ Technical Systems automotive technology lab, Koike Aronson Plate-Pro 1500 cutting machine. Total: $190,519.00

B. Chattahoochee Technical College, Network Support Maintenance Contracts for the maintenance and support of the current network infrastructure equipment at four campuses of the college. The maintenance agreement includes equipment maintenance, software updates, telephone support, site technician assistance, and a security component for intrusion detection and defense. Total: $55,000.00

C. DeKalb Technical College, 11 network chassis and 6 network expansion modules for instructional purposes and administrative offices, $109,459; Polycom videoconferencing equipment for administrative offices at the Clarkston and Covington campuses, $50,951; and technical equipment for the Advanced Technology Center, $27,838. Total: $188,248.00

D. East Central Technical College, two Lifepak 12 Biphasic defibrillator/monitors with supporting equipment for the Paramedic and EMT programs, $45,645 and 50 Dell computers ($1,486 ea) for classrooms and instructor offices, $74,290. Total: $119,935.00

EXECUTIVE COMMITTEE REPORT
Executive Committee reported that we are going to entertain the discussion at the Committee of the Whole regarding looking at possibilities for the strategic plan and this will be discussed further at the October Board meeting.

October Board Meeting will begin with lunch at North Georgia Technical College at the Blairsville campus, culinary arts department, Wednesday, October 13, and end the meeting on Thursday, October 14 at the Clarkesville campus for lunch. Details will be mailed at a later date.


CHAIRMAN’S REPORT

On behalf of the Board, Chairman Reynolds thanked Dr. Hodges for his service as Interim Commissioner during the search for the new Commissioner.

Chairman Reynolds thanked everyone that participated in the Capital Outlay meetings.
The requests are being reviewed and the outlay budget is being submitted September 15.


COMMISSIONER’S REPORT
Dr. Hodges thanked the Board for allowing him to serve as their Interim Commissioner and introduced new Commissioner, Mike Vollmer. Commissioner Vollmer responded with a few remarks of thanks and looking forward to serving in the capacity as DTAE’s Commissioner.

Dr. Hodges offered a special thanks to Board member, Rhubarb Jones for his endless work with adult literacy programs and especially the great job he does with the Adult Literacy Conference.
