I. F. 1. Employment of Presidents
The appointment of a President to fill a vacant position at a Technical College shall be based upon a search process developed by the Commissioner, in conjunction with the Executive Committee of the State Board. The Commissioner shall make the final selection and submit the name of the selected candidate to the State Board for approval.
The search process may include input from member(s) of the local community, Local Boards of Directors, state staff, and any other appropriate recommendation.
The reappointment of Presidents of Technical Colleges shall be made by the Commissioner in concert with the executive committee of the Board.
The President of a Technical College shall not have tenure and the term of office shall normally be for a period of one year.
The President of a Technical College who intends to resign shall inform the Commissioner of such intention as soon as possible, and in no event less than three months in advance.
In the event the Commissioner decides not to reappoint a Technical College President for the ensuing fiscal year, that decision shall be made known to the President, in writing, not later than May 31 of the current fiscal year. The Commissioner's decision to non-renew the contract of a Technical College President shall be made in consultation with the Executive Committee of the State Board.
The Commissioner may remove the President of a Technical College for cause at any time. Upon written request made within fifteen days of termination, any President so removed may request a statement of charges against him or her. Within fifteen days of receipt of such a request, the Department shall provide a written statement of charges. Such statement of charges shall advise the president of the right to request a hearing within ten days of receipt of the charges. If a hearing is requested, the State Board shall determine the procedures thereof and so notify the requesting party. The appeal may be heard before the State Board, a committee of the State Board or a hearing officer appointed by the State Board for report and recommendation. The actions of the State Board shall be final.
